Our Mission: Peak Scholars is committed to promoting lifelong learning by providing interesting, engaging, and effective classes and workshops to the community.

Terms & Conditions: Your registration and participation in classes and workshops offered at Peak Scholars LLC are subject to these terms and conditions. Please read these terms carefully and contact us if you have any questions.

  

GENERAL INFORMATION:

Certificates and Course Credit: Unless otherwise specified, Peak Scholars’ classes are non-college credit. However, certificates of attendance and completion can be issued upon request.

Instructors: All Instructors undergo CORI checks.

Books and Class Materials: Students may be required to purchase textbooks or other supplies at an additional fee. Instructors will advise. Please remember to bring any class material listed in the course description to the first class.

Handicapped Access: Our building is handicap accessible

Emergencies:Instructors will call 911 in the event of a serious medical emergency.

Late/Absent: Please notify the Director if the student is going to be late or not attending the class.

Location: The Peak Scholars’ Classroom is located at 32R Spring Street Medfield, Massachusetts within walking distance of the local high school, middle school, public library and town center.

Hours: Vary depending on class schedule.

Capacity: A maximum of 20 occupants is allowed.

SESSION REGISTRATION INFORMATION

I. PEAK SCHOLARS’ ACCOUNT

Following the initial consultation and agreement to Peak Scholars’ terms and conditions, scheduling an academic coaching or test prep session must entail a mutually agreed upon time, date, and location between the Academic Coach and the Student (and/or Student’s parent or legal guardian).

Peak Scholars account: All students must have a Peak Scholars account and fully complete registration before the first session with the Academic Coach.

II. SCHEDULING/RESCHEDULING SESSIONS

Scheduling:
All sessions are required to be booked via Peak Scholars online scheduler by the student or parent unless otherwise told by the Director. All sessions are filled on a first come, first serve basis.

Rescheduling more than 24 hours in advance:
To reschedule an academic coaching session more than 24 hours in advance of the start time of your appointment, students may do so by using the online scheduler first. If a student has difficulty rescheduling, please contact the Academic Coach directly via text, phone, or email and review possible reschedule dates until a mutually agreed upon time, date, and location can be found.

Rescheduling less than 24 hours in advance:
In order to reschedule less than 24 hours from the start time of your appointment, students will not be able to reschedule via the online scheduler and must contact their academic coach directly to reschedule. If academic coach and student cannot find a suitable time to reschedule, a $30 cancellation fee will be deducted.

III. SESSION CANCELLATION

Student Cancellations:

Peak Scholars’ Cancellation Policy
Any cancellations made less than 24 hours prior to the start time of the scheduled session must pay a cancellation fee of $30. “No shows” or cancellations made after the start time of the session, will be charged the full session fee. The cancellation policy is put in place to make sure all students have a fair chance to reserve time slots.

CLASS REGISTRATION INFORMATION

Registration: Students register for classes online or by phone.

Enrollment: All classes have registration deadlines and are filled on first come, first serve basis.

Payments: Full payment is due upon registration. We only accept credit card.

Withdrawals: If the Student needs to withdraw from a class or decides to not attend a class session…

  1. Contact the Director immediately by email or phone
  2. Upon confirmation, by the Student and the Director, the Director will then notify the Instructor via email (non-emergency) and/or phone (emergency)
  3. The Director will go over further withdrawal policies with the Student regarding refunds if necessary
  4. If the Student withdraws…
    1. Withdrawal at least 30 days before registration deadline date, 100% of registration fee minus 10% will be refunded to the original credit card charged.
    2. Withdrawal at least 15 days before registration deadline date, 100% of registration fee minus 50% will be refunded to the original credit card charged.
    3. Withdrawal after registration deadline date, all registration fees become non-refundable.
    4. Missed classes: All missed classes are non-refundable.

Class Cancellations: The Director or Instructor will contact students in the event of a cancellation or a rescheduled class.

  1. Under-enrollment: Peak Scholars reserves the right to cancel a class if there is low enrollment.
  2. Inclement Weather: Peak Scholars will contact instructor first, then notify students/parents/guardian by email as soon as possible.
  3. General Cancellations: Peak Scholars will notify students/parents/guardian immediately by email and phone.
  4. Last Minute Emergencies: Peak Scholars will notify students/parents/guardian by email and phone, and the Director will meet students at classroom if need be.
  5. Force Majeure Cancellation: Rescheduling in circumstances beyond the control of either Peak Scholars or the Instructor including but not limited to weather or sickness of the Instructor may occur. Under these circumstances, the class will be rescheduled to another date and time. If a student cannot attend the rescheduled date, there will be no refund for the class missed.

There may be situations where a class cannot be rescheduled. In this event, the Student will receive no refund.

Refunds: If Class or Workshop cancellation occurs students will be refunded…

  1. Under-enrollment: 100% of registration fee
  2. Before class begins: 100% of registration fee
  3. After class begins:If a class or workshop is cancelled mid session, Peak Scholars reserves the right to find a substitute instructor. If no substitute can be found, Peak Scholars will notify and reimburse students on a pro-rated basis via the original credit card charged.

 

PEAK SCHOLARS’ CLASSROOM RULES

Since Peak Scholars’ classroom is an enrichment learning space, all students will be expected to follow the safety and etiquette rules outlined below as well as any instructions and safety guidelines given to them by the Instructor. It must also be understood that in the event of an accident Peak Scholars cannot be held liable for any injuries that may be sustained to the Student during this time.

If any of the rules are broken, Peak Scholars reserves the right to refuse the use of the Peak Scholars’ Classroom by the Student. Should this occur, all payments will be forfeited.

Student Conduct: To insure a nurturing, informative, safe experience for all students, there will be no tolerance for bullying, bickering, horseplay, or any other behavior which will detract from the positive experience of any other student, or which could cause an unsafe situation. Repeated or willful violations of the regulations will result in possible dismissal from the class. Should this occur, all payments will be forfeited.

  • All exit doors must remain clear and unobstructed.
  • Smoking is STRICTLY PROHIBITED in the classroom
  • No candles, incense, or perfume spray. No burning materials of any kind
  • No nails, staples or tacks may be used to hang or mount anything. Only non-permanent, non-marking materials may be used to hang or mount anything in the Peaks Scholars’ Classroom.
  • No open flames in or around the Peak Scholars’ Classroom shall be allowed.
  • No animals are permitted in the building except those assisting handicapped individuals.
  • No running or horseplay.
  • No bullying.
  • Equipment is not to be removed from the building at any time, for any purpose.
  • Trash must be thrown out in the appropriate trash receptacles.
  • No Alcohol will be allowed on the premises.
  • Children must be supervised at all times.
  • Food & Beverage Rules: Snacks or lunches containing peanuts or other nuts are prohibited due to food allergies

PEAK SCHOLARS’ EMERGENCY PROCEDURES

Emergency Situations

The following types of events should be treated as an emergency:

  • If there is a fire and/or explosion, or if you see smoke
  • If someone has been injured or is experiencing some type of medical crisis. Some symptoms to look for are:
    • Uncontrolled bleeding
    • Loss of consciousness
    • Difficult breathing

General Emergency Procedure

  1. Notify everyone around you of the emergency situation.
  2. Call 911.
    1. Be sure to call 911 for any situation similar to those described above, even if you are not sure if the situation is an emergency. The dispatcher can determine if it is necessary to send emergency personnel.
    2. Call Peak Scholars’ Director Immediately
  3. Administer First Aid, if necessary.
  4. Evacuate the area, if necessary.
  5. Peak Scholars and/or Instructor will notify emergency contacts immediately and update them of the current situation

Emergency Contact Information:

 Peak Scholars supplies the Instructor a .pdf with all emergency contact information via email prior to class or workshop in case of an emergency.

 

PEAK SCHOLARS’ INTERNET POLICY

Users (Peak Scholars’ Students, Clients and Employees) are responsible for good behavior on Peak Scholars’ computer networks just as they are in a classroom. Communications on the network are to be considered public in nature. General classroom rules for behavior and communications apply.

Network resources are provided for the users to conduct research and complete coursework. Access to network services is given to the users who agree to act in a responsible manner. Access is a privilege, not a right. Therefore, based upon the acceptable use guidelines outlined in this document, Peak Scholars will deem what is inappropriate use and their decisions are final. Upon identification of inappropriate use of network services by the user, access may be denied, revoked, or suspended at any time.

Technology Resources and Internet – Acceptable Use and Safety Policy

I. PURPOSE
The purpose of this policy is to set forth policies and guidelines for access to the Peak Scholars’ Internet system and acceptable and safe use of technology resources and the Internet.

II. GENERAL STATEMENT OF POLICY
In making decisions regarding user access to the Internet, Peak Scholars’ considers its own stated educational mission, goals, and objectives. Electronic information research skills are now fundamental to preparation of citizens and future employees. Access to the Peak Scholars’ Internet system and to the Internet enables users to explore thousands of libraries, databases, bulletin boards, and other resources while exchanging messages with people around the world. Peak Scholars expects that Clients will blend thoughtful use of the Peak Scholars’ Internet system and the Internet throughout the curriculum and will provide guidance and instruction to students in their use.

III. DEFINITION OF TECHNOLOGY RESOURCES
Peak Scholars’ Internet systems and networks are any configuration of hardware and software. The systems and networks include an assortment of computer hardware, operating system software, application software, stored text, and data files. This includes electronic mail, local databases, externally accessed databases (such as the Internet), CD-ROM, optical media, clip art, digital images, digitized information, communications technologies, and new technologies as they become available. Peak Scholars reserves the right to monitor all technology resource activity.

IV. LIMITED EDUCATIONAL PURPOSE
Peak Scholars is providing the User with access to the Peak Scholars’ Internet system, which includes Internet access. The purpose of the system is more specific than providing the User with general access to the Internet. Peak Scholars has an educational purpose, which includes use of the system for classroom activities, educational research, and professional or career development activities. The Users are expected to use Internet access through the Peak Scholars’ system to further educational and personal goals consistent with the mission of Peak Scholars and classroom policies. Uses which might be acceptable on a User’s private personal account on another system, may not be acceptable on this limited-purpose network.

V. ACCEPTABLE USES
The Peak Scholars’ technology resources will be used only for learning, teaching, and administrative purpose consistent with the Peak Scholars’ mission and goals. Software or external data may not be placed on any computer, whether stand alone or networked to the Peak Scholars’ system, without following the guidelines outlined by the Peak Scholars’ Technology Team.

VI. USE OF SYSTEM IS A PRIVILEGE
The use of the Peak Scholars Internet system and access to use of the Internet is a privilege, not a right. Depending on the nature and degree of the violation and the number of previous violations, unacceptable use of the Peak Scholars’ system or the Internet may result in one or more of the following consequences: possible dismissal from the class with no refunds, cancellation of use or access privileges; payments for damages and repairs; discipline under other appropriate Peak Scholars’ policies, including exclusion or termination of contract; or civil or criminal liability under other applicable laws.

VII. UNACCEPTABLE USES
A. The following uses of the Peak Scholars’ Internet system and Internet are considered unacceptable for students and staff but are not limited to the following:

  1. The Users will not use the Peak Scholars’ Internet system to access, review, upload, download, store, print, post, receive, transmit or distribute:
  2. pornographic, obscene or sexually explicit material or other visual depictions that are harmful to minors;
  3. obscene, abusive, profane, lewd, vulgar, rude, inflammatory, threatening, disrespectful, or sexually explicit language;
  4. materials that use language or images that are inappropriate in the education setting or disruptive to the educational process;
  5. information or materials that could cause damage or danger of disruption to the educational process;
    e. materials that use language or images that advocate violence or discrimination toward other people (hate literature) or that may constitute harassment or discrimination.
  6. The Users will not use the Peak Scholars’ Internet system to knowingly or recklessly post, transmit or distribute false or defamatory information about a person or organization, or to harass another person, or to engage in personal attacks, including prejudicial or discriminatory attacks.
  7. The Users will not use the Peak Scholars’ Internet system to engage in any illegal act or violate any local, state or federal statute or law.
  8. The Users will not use the Peak Scholars’ Internet system to vandalize, damage or disable the property of another person or organization, will not make deliberate attempts to degrade or disrupt equipment, software or system performance by spreading computer viruses or by any other means, will not tamper with, modify or change the Peak Scholars’ Internet system software, hardware or wiring or take any action to violate the Peak Scholars’ security system, and will not use the Peak Scholars’ Internet system in such a way as to disrupt the use of the system by other users.
  9. The Users will not use the Peak Scholars’ Internet system to gain unauthorized access to information resources or to access another persons materials, information or files without the implied or direct permission of that person.
  10. The Users will not use the Peak Scholars’ Internet system to post private information about another person or to post, transmit or distribute personal contact information about themselves or other persons, or other personally identifiable information, including, but not limited to, addresses, telephone numbers, personal addresses, work addresses, identification numbers, account numbers, access codes or passwords, labeled photographs or other information that would make the individual’s identity easily traceable, and will not repost a message that was sent to the user privately without permission of the person who sent the message.
  11. The Users will not attempt to gain unauthorized access to the Peak Scholars’ Internet system or any other system through the Peak Scholars’ Internet system, attempt to log in through another persons account, or use computer accounts, access codes or network identification other than those assigned to the user. Messages and records on the Peak Scholars’ Internet system may not be encrypted without the permission of appropriate Peak Scholars’ authorities.
  12. The Users will not use the Peak Scholars’ Internet system to violate copyright laws or usage licensing agreements, or otherwise to use another persons property without the persons prior approval or proper citation, including the downloading or exchanging of pirated software or copying software to or from any computer, and will not plagiarize works they find on the Internet.
  13. The Users will not use the Peak Scholars’ Internet system for conducting business, for unauthorized commercial purposes or for financial gain unrelated to the mission of Peak Scholars. The Users will not use the Peak Scholars’ Internet system to offer or provide goods or services or for product advertisement. The Users will not use Peak Scholars’ Internet system to purchase goods or services for personal use.
  14. If the User inadvertently accesses unacceptable materials or an unacceptable Internet site, the user shall immediately disclose the inadvertent access to Peak Scholars. This disclosure may serve as a defense against an allegation that the user has intentionally violated this policy.

 

VIII. LIMITED EXPECTATION OF PRIVACY

A. By authorizing use of the Peak Scholars’ Internet system, Peak Scholars does not relinquish control over materials on the system or contained in files on the system. Users should expect only limited privacy in the contents of personal files on the Peak Scholars’ Internet system.
B. Routine maintenance and monitoring of the Peak Scholars’ Internet system may lead to a discovery that a user has violated this policy, another Peak Scholars policy, or the law.
C. An individual investigation or search will be conducted if Peak Scholars has a reasonable suspicion that the search will uncover a violation of law or Peak Scholars’ policy.
D. Peak Scholars will cooperate fully with local, state and federal authorities in any investigation concerning or related to any illegal activities or activities not in compliance with Peak Scholars’ policies conducted through the Peak Scholars’ Internet system.

IX. INTERNET USE AGREEMENT

  1. The proper use of the Internet, and the educational value to be gained from proper Internet use, is the joint responsibility of Students, Parents, Clients and Employees of Peak Scholars.
  2. The Internet Use Agreement form for users must be read and agreed to by the user and the parent or guardian if necessary.

X. LIMITATION ON PEAK SCHOLARS’ LIABILITY

Use of the Peak Scholars’ Internet system is at the User’s own risk. The system is provided on an “as is, as available” basis. Peak Scholars’ will not be responsible for any damage the Users may suffer, including, but not limited to, loss, damage or unavailability of data stored on Peak Scholars diskettes, tapes, hard drives or servers, or for delays or changes in or interruptions of service or mis-deliveries or non-deliveries of information or materials, regardless of the cause. Peak Scholars is not responsible for the accuracy or quality of any advice or information obtained through or stored on the Peak Scholars’ Internet system. Peak Scholars will not be responsible for financial obligations arising through unauthorized use of the Peak Scholars’ Internet system or the Internet.

XI. USER NOTIFICATION

  1. All Users shall be notified of the Peak Scholars’ policies relating to Internet use.
  2. This notification shall include the following:
  3. Notification that Internet use is subject to compliance with Peak Scholars’ policies.
  4. Disclaimers limiting the Peak Scholars’ liability relative to:
  5. Information stored on Peak Scholars’ diskettes, hard drives or servers.
  6. Information retrieved through Peak Scholars’ computers, networks or online resources.
  7. Personal property used to access Peak Scholars’ computers, networks or online resources.
  8. Unauthorized financial obligations resulting from use of Peak Scholars’ resources/accounts to access the Internet.
  9. Notification that, even though Peak Scholars may use technical means to limit student Internet access, these limits do not provide a foolproof means for enforcing the provisions of this acceptable use policy.
  10. Notification that goods and services can be purchased over the Internet that could potentially result in unwanted financial obligations and that any financial obligation incurred by a User through the Internet is the sole responsibility of the User and/or the User’s parents.
  11. Notification that the collection, creation, reception, maintenance and dissemination of data via the Internet, including electronic communications, is governed by Policy 405, Public and Private Personnel Data, and Policy 514, Protection and Privacy of Pupil Records.
  12. Notification that, should the User violate the Peak Scholars acceptable use policy, the users access privileges may be revoked, consequential actions may be taken and/or appropriate legal action may be taken.
  13. Notification that all provisions of the acceptable use policy are subordinate to local, state and federal laws.

 

XII. IMPLEMENTATION; POLICY REVIEW

  1. Peak Scholars’ Internet policies and procedures are available for review by all Students, Parents, Guardians, Clients, Staff and members of the community.
  2. Because of the rapid changes in the development of the Internet, Peak Scholars shall conduct an annual review of this policy.

 

PEAK SCHOLARS PHOTO AND MEDIA POLICY

Photos and Media: Peak Scholars will use audio and visual media in several classes. Audio and visual material, including written work, visual art, photos and videos created within Peak Scholars’ Classroom, may be used on Peak Scholars’ website and other social media outlets for public relation and marketing efforts. Names are not published. This includes media that may need to be uploaded to an external host before posting on Peak Scholars’ page. Clients and Parents/Guardians must write a signed letter to the Director stating limitations or refusal in order for student to not be photographed. Absent such written limitation or refusal shall indicate your consent to allow photo and video of the Client or registered student(s) to be used for promotional and/or educational purposes.

Security: Peak Scholars may install security cameras for the benefit of everyone i.e. Peak Scholars LLC, the Client, and the students.

PEAK SCHOLARS’ CONTENT POLICY

Class Content: Peak Scholars’ courses and content are for Peak Scholars’ Students only: All content, including but not limited to Materials, Digital Materials, lectures, recordings, visual and audio aids, content available from peakscholars.com, and all content that the Student will receive or to which the Student will have access during the course (collectively, “Content”) is for the Students’ personal use only and may not be shared, resold, auctioned, or transferred to another person in any manner.

Copyright and Non-Duplication: Content is protected by copyright law. Without Peak Scholar’s authorization, students are strictly prohibited from downloading, recording, duplicating or reproducing any Content in any manner or medium under any circumstances. If a student is found to be in violation, the student will be subject to disciplinary and legal action, including but not limited to any or all of the following:

  • Immediate removal from the facility and termination of enrollment in the Course
  • Forfeiture of registration fees paid
  • Excluded from enrolling in any future Peak Scholars’ Courses; and
  • Possibility of civil penalties and criminal prosecution. Willful Infringement of copyrighted works may result in federal imprisonment of up to five years and $250,000 in fines.

 

Student Code of Conduct: As part of Peak Scholars’ commitment to our student’s success, we seek to provide an optimal learning environment and expect students to conduct themselves in a manner that is considerate of those around them. Those failing to meet student conduct standards may be subject to disciplinary actions, including but not limited to termination without refund. Inappropriate classroom conduct includes but is not limited to: (1) disruptions to the learning environment (i.e. use of profanity, harassment, cell phone use in classrooms, etc.); (2) deliberate destruction, misuse, or theft of Peak Scholars property or the property of fellow classmates; (3) violence or threats of violence toward persons or property of students or Client or Peak Scholars’ staff; (4) improper use of email and Internet access; and (5) failure to comply with federal copyright and criminal laws forbidding the misappropriation, copying, or alteration of copyright-protected materials.

Disclaimer and Limitation of Liability: PEAK SCHOLARS EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, RELATING TO THE COURSES, INCLUDING WITHOUT LIMITATION THE SITE, THE MATERIALS, AND CLIENTS (INSTRUCTORS) 

Privacy Policy: This privacy policy explains how Peak Scholars including its subsidiaries, affiliates and parent companies collects, uses, shares and protects personal information that we collect.

Information We Collect: We collect information that you voluntarily provide to us, including personally identifying information such as your name, postal address, e-mail address, educational background, educational goals and interests, and credit card information (“Personal Data”). We collect Personal Data from you in various ways, including when you enroll for courses, use online resources, access and use Digital Materials, participate in classes or tutoring, and send us feedback. We may also collect Personal Data about you from our business partners. When you log-on to our websites, we automatically receive information from your computer and browser, including your IP address. Peak Scholars may use cookies and web beacons.

Use of Your Personal Data: We may use your Personal Data in the following ways:

  • To fulfill your requests for products and services, such as enrolling you in a courses, delivering educational content or responding to a specific inquiry;
  • To customize your learning experience to you;
  • To administer, support, improve and develop our business; and
  • To send you information about Peak Scholars products or services.

Disclosure of Your Personal Data: We do not share your Personal Data with third parties for their marketing purposes. We may disclose your Personal Data in response to legal process, to protect our rights, as otherwise required by law, or for the prevention or detection of a crime. If we sell our company or part of it, or our business enters into a joint venture with another business entity, we may disclose your Personal Data to our new business partners or owners who may then provide you with information about their products and services. We may share your Personal Data with trusted third parties who are delivering services to Peak Scholars. Peak Scholars may disclose anonymous data with third parties. We may also share your information with third parties that you have specifically designated as authorized to receive information from us. For example, if you are a student, subject to your consent we may provide information about your participation and performance to your school teacher.

Information Retention: The Personal Data we obtain from students allows Peak Scholars to deliver smarter, more efficient and more effective instruction.

Arbitration & Class/Collective Action Waiver:Any and all disputes arising from or related to this Agreement, other than disputes relating to intellectual property infringement, including whether the dispute is arbitrable and the scope of this arbitration agreement, shall be finally resolved by arbitration administered by a single arbitrator under the then-applicable rules of the American Arbitration Association in accordance the Federal Arbitration Act. The arbitration shall be governed by and construed by federal law to the fullest extent possible. Unless otherwise agreed by the parties, the arbitration shall take place in the largest city within 100 miles of your permanent residence. Judgment on the arbitral award may be entered in any court having jurisdiction thereof.

To the maximum extent permitted by law, should you wish to initiate a legal action against Peak Scholars, you waive any right or ability to be a class or collective action representative or to otherwise participate in any putative or certified class, collective or multi-party action or proceeding based on such a claim in which Peak Scholars or a related entity is a party. The same applies to Peak Scholars’ legal actions against you. Thus, you and Peak Scholars agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class. Further, unless both you and Peak Scholars agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over a representative or class proceeding.

Miscellaneous
This Agreement supersedes all prior oral or written agreements, if any, between the parties and constitutes the entire agreement between the parties. The agreement cannot be changed or modified orally. Any change or modification must be in writing and agreed to by both parties. If any provision of this Agreement is found to be unenforceable for any reason, such provision shall be construed by limiting it to make it enforceable to the maximum extent permitted by law, and the remainder of this Agreement shall continue in full force and effect.
